Who Is at Fault for an Uber or Lyft Accident?
If you are a passenger involved in an Uber or Lyft accident, the question of fault and who is responsible for your injuries and damages depends on who was at fault for the accident. To prove that either the rideshare driver or the other vehicle’s driver is at fault means you, as the injured person, must prove that the person who caused the accident was negligent.
Negligence requires proof of the following:
- The person who caused the accident owed a duty of reasonable care to operate his or her vehicle safely and follow all traffic laws;
- The person who caused the accident breached that duty, meaning he or she failed to obey a traffic law or did not drive safely and carefully;
- The passenger was injured and suffered damage as a result.
Since Florida is a no-fault state, drivers are required to carry personal injury protection (PIP) coverage. This insurance coverage is meant to cover your medical expenses and other non-medical related costs. However, if injuries and damages surpass the $10,000 PIP coverage, the injured party can seek payment from the negligent party’s insurance.
Filing an Insurance Claim in an Uber and Lyft Accident
If the rideshare driver was determined to be at-fault for the accident and your injuries meet or exceed the state standard for “serious injury,” you, as the injured passenger can file a claim against the rideshare company’s $1 million insurance policy.
Florida law views serious injuries as those that are permanent, involve significant and permanent scarring or disfigurement, or significant and permanent loss of a bodily function. Florida law requires rideshare drivers, specifically Uber, to carry $1 million in insurance to cover these exact types of accidents, covering both the driver and passengers who may be injured in a rideshare auto accident.
Uber offers the following breakdown of its insurance policy.
When the Uber app is turned OFF: In these instances, only the driver’s personal auto insurance can be used. As they are not technically on the job, Uber cannot be held responsible for damage caused in an accident.
When the Uber app is turned ON and the driver is available or waiting for a ride request: Both the driver’s personal insurance and Uber’s insurance coverage can be used, which includes up to $50,000 to $100,000 for injuries, and $25,000 for property damage.
When the Uber app is turned ON and the driver is in-route: The company’s commercial insurance coverage is provided, including up to $1 million in third-party responsibility and $1 million in uninsured or underinsured motorist coverage. Uber maintains the following auto insurance policy in the case of a covered accident:
- $1,000,000 third-party responsibility
- Uninsured/underinsured motorist bodily injury
- Contingent comprehensive and collision –Up to actual cash value of car with a $2,500 deductible (Effective 3/1/2021)
Know Your Legal Rights after an Uber / Lyft Auto Accident in Central Florida.
Florida law provides important protections for passengers and drivers who are injured in accidents involving Uber and Lyft rideshares. If you were seriously injured in an auto accident involving an Uber or Lyft ridesharing vehicle, you may be entitled to substantial compensation. These companies are required to carry additional insurance beyond the state’s minimum requirements. Keep track of your symptoms (both physical and mental) as they occur. If anything feels not normal or out of the ordinary, make sure you document that fact and inform your doctor. Do not sign off on any settlement initially offered by your insurance (or the other driver’s) insurance company, before speaking with an attorney, first. Don't Just Take Our Word for It
“The Benenati law firm makes you believe that you are the single most important PERSON (not case) to them. Throughout the entire process, they maintained weekly contact with me, asking how I was doing or if I needed anything. I was provided with frequent updates as to how my case was progressing and was pleasantly surprised with the speed at which they were able to reach a substantial settlement. I've had the unfortunate experience of dealing with other well-known personal injury attorneys in Orlando who were unable to provide the level of expertise, care and service that Walter Benenati and his team can!”
“I would like to thank the Benenati Law Firm for helping to take the stress out of dealing with the insurance company and for everyone being very professional and always available to take my calls. The speed of the case being closed exceeded my expectations and any future needs I will definitely be contacting them.”
“My experience with the Benenati Law Firm in Orlando was a great experience. They helped right away after a heartbreaking experience at another law firm. THEY MADE MORE PROGRESS IN MY CASE IN TWO MONTHS THAN 2 YEARS WITH MY FORMER LAW FIRM. I am so grateful.”
